TERMS AND CONDITIONS - GSM COMMUNICATION SERVICES LTD.

Confidentiality: You agree in perpetuity to keep all information provided or discussed in the Mobile Entertainment and Advertising Summit (“Summit”), whether disclosed orally, in documentary form, by demonstration or otherwise, confidential; provided that such information shall not be confidential if the information is public knowledge or already known to you at the time of disclosure or subsequently becomes public knowledge other than by a breach of this clause. Payment: Payment must be made & cleared five (5) working days prior to the commencement of the Event. GSM Communication Services Ltd. (“GSM”) reserves the right to charge interest at the rate of five percent (5%) above LIBOR for every day that payment is late. Where VAT is applicable, this will be stated on the invoice.

Cancellation: If payment has been made in full a refund less a service charge of forty-five Euro (€45) will be made if cancellation is received in writing before a minimum of fourteen (14) days. The beneficiary bank will pay all bank charges. After this date no refunds will be made but a substitute delegate is welcome to attend. Cancellations should be notified to the GSM email to booking-meas@gsm.org, or by fax to +353 1 289 1800.

The GSM reserves the right to cancel any Summit. In this case, the GSM will return in full any fees received. The GSM will not refund any other costs you incur as a result of this cancellation.

Summit Content: It may be necessary for reasons beyond the control of the organisers to alter the content and the timing of the programme or the identity of the speakers.

Limitation of Liability: You are responsible for taking care of your own property. To the fullest extent permitted by applicable law, under no circumstances, including, but not limited to, negligence, shall the GSM, its parent or affiliated companies and their employees and members be liable to you for any direct, indirect, incidental, special or consequential damages that result from participating in the Summit or use of any material or information obtained from any Summit.

Indemnification: You agree to defend, indemnify, and hold the GSM its parent or affiliated companies and their employees and members harmless from and against any and all claims, damages, expenses, including attorney’s fees, arising from and related to participating in the Summit.

Law and Jurisdiction: These Terms and Conditions are exclusively governed in accordance with the laws of the Republic of Ireland and subject to the exclusive jurisdiction of the courts of the Republic of Ireland.
